HI
I completed my Trust Deed last year and received a Letter of Discharge of Debtor form 5.
I don't think I received a certificate of Discharge which is stamped by the court. My bank is asking for this cetificate complete with stamp by the court, where can I get this?
thanks
Hi suzzylucky13.
Kevin or David will correct me if I'm wrong, but I'm really not at all sure that this document even exists in respect of trust deeds in Scotland.
Sounds to me as though the bank are mixing this up with a different type of UK personal insolvency.
Form 5 is the documentation of your discharge. It becomes official once acknowledged on the Register of Insolvencies.
You may still be able to find your own case details on the Register of Insolvencies with a confirmed discharge date. The bank can also directly access these official records online.
Hi,
Your right TDA the Form 5 isn't stamped by the court or issued by the court.
I think the bank are getting mixed up.
Your Form 5 Suzzy is your discharge and confirmation that you have completed your Trust Deed.

Thank you both, I didn't think there was a certificate. I have already sent my Form 5 to them.
The bank is driving me crazy with this.
I have informed the bank.
Thanks again !!
Hi suzzy,
Sometimes you need to be a little persistent with the bank to speak with the right department/person that knows about the Scottish system.
If you are looking to work on improving your credit rating then Firewalker a poster on the forum is great for advice. If you use the search function and search for “Firewalker” it should bring up their posts and you can have a read.
Keep at it. You will eventually get things resolved.
