Bankrupt

Good evening everyone. I'm new to this forum.

I, unfortunately declared myself bankrupt a few weeks ago. My bank accounts, debts etc, are all in my name only.

My question is, 1 of the creditors is the same company my husband has his overdraft with, can they chase my husband for immediate payment on his overdraft (which he is paying off weekly)

Thanks for any advice.

It sounds like your husband has an informal arrangement to repay this overdraft?

I'm sure they could call the full amount in if they wanted, but I doubt that they will if he sticks to the agreement.

Can the bank link his account to my old account via our address? Both accounts have never been a joint account.

They may be able to link you, but the accounts and your affairs are separate.

If there is an agreement I doubt that they'd choose to change it for this reason.

If they choose to call in your husbands overdraft account, it will not be because of your bankruptcy. The account has never been joint, so your breach of contract by going bankrupt cannot affect your husbands account. It would possibly be different if it had been a joint account.
You will likely be linked on your credit reference file as you are married.

As long as the accounts were not in joint names, then it would not have an effect on your husbands account.
