Hi can anyone help with the following . I entered a ptd 12 months ago and my bank account was part of it as i had an overdraft etc with them. Someone has accidentally paid money into this account so i am wondering if the bank will keep the money? I called yhe bank and they said they couldny see any open accounts in my name but the money still hasnt bounced back to the sender? Thanks

Hi Nikkifergie.

I think all you can do is reason with your bank, or perhaps enlist the support of your trustee to do the same.

Hopefully they'll make a decision you consider to be fair.

Hi Nikkifergie,

Itโ€™s something to speak with your Trustee about as they may be able to help although they will want to know how much money you have been paid and what this is for. If for example this is inheritance then the Trustee could consider ingathering the funds for the benefit of creditors.

Also speak with the bank again to clarify if the old account is actually closed. Sometimes the first person you speak with on the phone at the bank might not be the best person and you might need to ask to be put through to the Insolvency / Bankruptcy team.

This happened to me, although it was a DAS I had so not sure if it's different? The bank refunded the person later (although not immediately) after she got in touch with her own bank to inform them of her error. It was showing as a credit on a suspended account.
