Hi guys, im hoping you guys with all your knowlege can give me some advice and guidance. Im honestly at my wits end!my trust deed is complete, ive been discharged, all dividends paid out to creditors. Trustee diacharged etc. After a bit of chasing all creditors (apart from one) have marked accounts as settled. The one who has caused a major problem is creation consumer finance. They received their payment in april, instead of settling the account they took it as a payment and took it off the total debt. After months of phonecalls, letters and emails they told my in july that they had sold the account onto lowell portfolio. I informed my trustee of this and they also sent letters etc. Creation have admitted that they sold the account in error and promised to get the account back and close it, they have aince been removed from 2 of the 3 credit files. I also contacted lowell on several occasions who claimed to have no record of me. I checked my exoerian and equifax reports a few days ago to find that lowell portfolio has appeared with a full outstanding balance. I contacted them and was assured this was an internal error and would be rectified. I told them I was also raising a diapute through experian due to the isaues with creation. I did this and experian have got back to me telling me that lowell are aaying the account, balance and default is correct (even tjough creation never issued a default, they only marked late payment)
So I contacted lowell again and was told that they have now sold the account again and had no record of my initial phonecall to them. Ive raised a formal complaint with them but they really dont seem to care. I cannot face the stress of now having to chase a 3rd company all because of a mistake creation made. Any advice guys on how I can get this sorted. Its dragged on for months and everytime I think im getting somewhere I end uo back at square one. My last defaults are due to fall off next month and my trust deed will be gone in february. My crefit score was rising well until this and its plummeted again.

Hi Pedy,

This is just a guess, but I suspect when Lowell state that the debt has been sold that it has, in fact, gone back to Creation. Were you given a different company name when they told you it had been sold?

If that's the case then a formal complaint to Creation may help to move things along.

This is probably worth doing in any case, because they have some responsibility for the conduct of parties that they sell debts to.

This must be very frustrating Pedy.

I hope that your complaints help to move this forwards soon.

You can go to the Financial Ombudsman if you remain unhappy after you have received final responses on the complaints.
