Hi i found this forum for some advice,
i havea protected trust deed in place of which i have had for a year now. i have just completed my annual review of which i have recieved a letter from my trustee stating a 137pound surplus. i have forget to add my monthly internet, union payments and the need to obviously cover mot and road tax for the year plus i have 2 kids from prev relationship. their child maintenence has been included but when i have acces to my kids i also have the cost to keep them.
i also have changed cars due to my car at time of trust deed neeeding scrapped as was old and to costly to repair but my girlfriends mum knowing my situation bought me a a car for a 1,000 pound as i require for work and family to help me. they want to know how i funded this of which i am worried they might take car off me.
I am paying a 196pound a month to my trustee of which is all i can really afford as im always pennyless before my next wage so do not wish to pay more as this will affect me.
also i have ever since getting my trust deed get weekly calls from other companys wishing to provide me with one. On the off chance i discussed my trust deed and they were surprised that with my initial 11,500pound debt i was paying 196 pound over 4 years = 9,500. they said that i was paying to much for what my debt was. I am greatful to be in a trust deed as i see an end to my debt i didnt see before due to intrest payments but if the trustee takes the surplus then i will be paying way more than my actual debt of a year ago.

i would suggest asking your girlfriends mum to write a letter if she knows about the trust deed to your trustee explaining that she purchased it for you, also you should sent a letter to them or email them yourself explaining that you missed a number of items of your review and highlight the ones you can on a copy of a bank statement and explain that you also need a montly amount towards the up keep of the car which if this was in your last review then you should already have a figure in mind, i always took the cost of road tax, mot and possible repairs based on advisories from previous mots added together and devided by 12. you need to remember that on top of your debts is the trustees fee usally 2-4 thousand pounds and when signing a trust deed you agree to paying any surplus income, you should really consider listing absolutly everything on your reveiw and tell your trustee if anything changes, if your pot were to overflow at the end i am sure you would get the left over, you should get statements as to how much you have paid in over the time and im sure you could approach your trustee to end early if everything is paid off including the fees.

Welcome to the trust deed forum jagos.

As gemgem says, your trust deed payment should be based upon affordability including all of your essential expenditure. If you have missed essential elements of expenditure from your review you should go back and ask for everything to be reassessed.

Given the circumstances I doubt there will be an issue with the car.

It would appear that the trust deed provider you selected has extended the term to four years to cover their fees. It might have been possible previously to find a company that would have handled this over a shorter term (because they charged a lower fee). You're not paying "too much" in terms of your debt level though, the monthly payment is based on affordability and the term is based on the agreement between you/your Trustee/your creditors.

Thank you both for the advice. I will phone them today and say i wish to reassess my review as i have the original monthly income and expenditure statement which shows the stuff i missed and my income has not changed. Thanks again it is much appreciated when you dont know the ins and outs.

thank you gemgem, phoned them yesterday and they are sending the review back out to fill in again. i also explained about the car and they are happy with my girlfriends mum writing a letter just to explain she purchased the car so will let you know how i get on.

That's great news, it sounds like it's all coming together, I would also suggest putting in say ยฃ50 or something for the up keep of your children and travel expense if you have to collect them when they stay with you, let's face it worst case the trustee does not allow that much or nothing at all, however if you don't ask you don't get. thanks again for all advice given. gemgem just to let you know i re-completed my annual form when sent back to me with letter about car situation and have just recieved a letter from my trust deed stating no changes to payments. Its good to know now that my payments are staying the same as i could not afford more than what i pay already.
