Hi guys

31st August 2010 I signed my Trust Deed and it became protected 5 weeks later.
At that time my wife and I had a joint bank account with a major high street bank as she is employed by them and has to have her wages paid into one of their accounts.
My wife decided not to enter into a TD as it could have had a major impact on her job i.e. being dismissed.
At the time we were using the max overdraft of ?ú 2500. I changed to a different bank but she cant cause of her wages.
Anyway, Mid - October they wrote to us informing that they were freezing the joint account as it was one of my creditors in my PTD. She had to arrange via her wages dept to have her wages paid into a savings account she had ( was only ?ú 1.23 in it ) and then transfer her wages into a different bank account in a different bank.
This was going ok until today when we both received letters from a debt collection agency demanding ?ú 2911. 45 reg the frozen account.
I phoned them and explained my position and was told to disregard the letter but for my wife to contact them.
My question is this really: Although the ?ú 2911.45 is inc in my PTD, as it was a joint account is my wife still liable for this debt?
Apologies for the length of post, was trying to give a clear overall picture.

Hello Sherbo,

I'm afraid that if it's a joint account you are both individually responsible for the full amount of the balance.

Your trust deed takes care of your part of the responsibility, but your wife remains liable for the full balance (minus any amounts that eventually go towards the balance from your trust deed).

If a debt collection agency have become involved they are likely to accept a monthly repayment plan being put in place by your wife to clear the debt down over time at an affordable rate.
