I asked this on a previous topic but didn't really get the answer to this particular point.
I am currently in process of getting my Trustee Discharge Date and or Debtor Discharge Date applied to the AiB Register as for some reason this hasn't been done already even though I am almost at my 6 year mark (within next 6 months).
Will my name ever be removed from this list? Or will the details just be updated and remain on there for all to see? I'd imagine even though I have done my 6 years and been fully discharged etc this would still look bad against my name for say getting a mortgage?
Hi bl1985.
I thought someone had answered this previously on another topic that you'd contributed to.
Normally your entry would be removed from the register one year after trustee discharge. I therefore assume, if your trustee was discharged more than a year ago, that the AIB might remove your entry from the public register at the same time as they update everything. You should check this with them though.
Will the AIB keep permanent records? I'd assume so - you'd have to check with them - but they're not public records.
I'd assume that your trust deed was "advertised" in the Edinburgh Gazette given that you started this a fair while ago (it's changed now). I'm afraid that I believe this to be a permanent record and can be searched online.
Will banks keep their own records of old insolvencies? Quite possibly - though if/how they use this information when an application for credit is received is a matter for them.
Can any lender ask you whether you've ever been insolvent when you make an application for credit? Yes, and you'd be obligated to answer honestly irrespective of whether it's on your credit record any longer. How would they use this information? It will vary from lender to lender.
Hi bl1985,
In terms of the Register of Insolvencies (ROI), your details will remain on there for 1 year following your Trustees discharge. After the 1 year your debts will fall off of this.
If you are 6 years from the start of your Trust Deed and your Trustee has been discharged then your details should not be on the Register of Insolvencies.
When it comes to mortgages lenders will consider a number things such as credit status, level of deposit, income, affordability and past Insolvencies.

Thanks for the help and information.
Yes it was advertised in the Edinburgh Gazette .
As for being obliged to tell them, I understand and am always upfront and honest but if the questions aren't asked I would certainly refrain from putting that information on the table, is this being dishonest? I certainly don't think so.
