AIB Reopening Sequestration cases for PPI

I had trust deed and the trustee (KMPG) and myself are both discharged. And its been register with the AIB. Then out of the blue the Co-op Bank wrote to us saying that had re-assed a PPI claim that I made after I had been discharged. They said that they had to offer the PPI amount to the Trustee and ask whether the trustee wanted they money. I heard nothing for over 2 months so I got in touch with the bank and they said that I had to sent them my discharge letter which I did.

Then today I got a letter from the bank saying that the trustee have asked them not to release the payment because they are waiting on the outcome of a judicial review which is currently taking place. The judicial review is regarding cases were a customer has been discharged from their trust deed but there is redress due as a result of a review of the sell of PPI.

Has anyone heard this about this judicial review?

Welcome to the forum Castlerock.

I've not heard of any judicial review specifically, but we have heard from a few people that their trustees are monitoring developments in this area.

Had ppi letter recently saying after review they owe me.more money than they paid out directly to myself recently but due to trust deed (10 years ago )they have released money to them . I have copy of letter from.trustee from.last time dying that I have been descharged from trust deed and any money due would be payable to myself and have sent bank copy of this bit have just called trustee and they say rules have changed and they want to re open trust deed to pay creditors and money won't be release to me x what can I do about this can they change mind when I already have letter sayingy have. o intereSt even if from 2013 the letter

Trust deeds being re-opened to capture PPI has been a developing theme this year.

If you want to challenge such a decision you can probably do so in court. My understanding is that the trustee would have to go to the court for permission to reappoint themselves.

To top this off just got letter that I've waited 2 1/2 years for from financial ombudsman saying case for ppi upheld and getting full refund for a loan also with lloyds , take it the same is going to happen to this send to trustee not me now or is there any way Of refusing payment to trustee

In terms of trying to prevent this from happening, I can only really suggest you seek out your own legal advice if you feel strongly enough about it.
