Advice re CCJ

Hi
Im wondering if anyone is able to advise or help me as I am going round in circles.

I started proceted trust deed in July 10 and was discharged in March 14. I was issue a County Court Judgment in Jan 11 and this is still appearing as active on noodle credit file report.

I had first contact Noodle, who advised to contact local court with a copy of discharge trust deed, which I did. Then the court got back to say that they had no involvement in clearing credit files and to contact MBNA who raised this. I contact them and was advise debt had been pass on to max recovery and were being represent by Evershed. Evershed got back to me yesterday to say they have up date the debt to satfised but in order for the CCJ to be marked as satifised I would need to contact Hamilton County Court with a copy of this email and the assignment notice, they will be able to satisfy the CCJ. I did this and again court come back to say this is procedure in england and not scotland and I should contact credit file company.

Does anyone know how I can get this CCJ updated, really stressing me out as want to start rebuilding my credit score, which I know will take years but at the moment sitting 1 out of 5 and my husband has jump to 3 out of 5 (he was in trust deed at same time).

Any advice would be much appreciated

Were you resident in England at the time that this happened?

We did have a similar thread recently regarding a decree that had been issued in Scotland.

It was explained by the experts that a creditor was free to do this (albeit that it's a bit of a waste of time and money) and the protected trust deed prevents it being enforced rather than it being issued.

No I have always lived in Scotland, I just want it up dated to reflex not longer active but it seem to be proving very difficult to do so and I have no idea this will appear on my credit file.

Help anyone??

Hi sharon21.

I'd suggest contacting the Information Commissioners Office to get their view.

Each time we've done this they've been very on the ball and helpful.
