Hi, My husband is in a trust deed, and I am on a debt management programme. I have recently become employed and have arranged an increase in my payments to my creditors.
My wages are paid into a joint bank acc, will my husband be required to increase his payments due to a increaase in the money in the bank ?

Hi marti11.

It's a slightly difficult one to explain, but I'll do my best and please let us know if it doesn't make sense.

When calculating your husband's trust deed contribution the trust deed provider will have looked at your total household expenditure. If his was the only wage, he would effectively have been paying all of the bills which would reduce his ability to contribute towards the debts.

As you will now also have a wage it is fair, from the perspective of his creditors, that some of the responsibility for paying the household bills should now fall on you as well. This will have the effect of reducing his expenditure which consequently will have the effect of putting him into a position to repay more to his creditors via the trust deed.

Therefore I think it's likely that the Trustee will require an increase in the trust deed contribution when the next review is done. This is based on ability to pay, not on the amount of money that happens to be in your joint bank account.

I'd suggest that you don't wait for the review to tell the trust deed company about this change though, as if they want an increased payment the delay might result in arrears that could lengthen the term of his trust deed.
