Hi folks, it's been a while since my last post but I am need of some advice, my trust deed was transfered over to apex and they have sent me forms to fill out for income and expenditure so ok here's the tRicky part, due to hard times I stopped paying my TD for a while so I managed to land a very good job with more income so I have been paying extra in to catch up which I have done so that's great, but my issue is apex have now seen this and want to increase my monthly payments but with this job is a weird one I am employed direct through a company but I have to pay my own tax contributions so I never know what I am going to make from month to month as it varies A LOT and I don't know what to do for the best and what will happen if my TD finds out I have to pay my own tax? Any help very much appreciated!

Also apex wants to see 2 of my payslips which will show no deductions for tax and also this is going to cause a lot of problems I think, per month if I don't do any work I get a guaranteed 1600 but I went away for 4 weeks recently and made 14k now if apex see this they will want a fortune off me but I might only get that 1 trip a year or I might get 5 or 6 there's no way of telling it depends on a lot of things

Hi whitley87.

Trustees are very used to dealing with self-employed clients that have variable incomes and who have to pay their own tax.

You just need to explain everything to them in a detailed way so that they understand your situation fully.

They can then work out how much you need to set aside for tax, how much you need to live, and how much is left over that your creditors can reasonably expect to receive under the terms of the trust deed agreement.

Because your pay varies so much they may choose to work with you to monitor everything on a month-to-month basis.

Thanks tda, is there any rules against becoming self employed while being in a TD? As I've just started I won't have books or anything to give them if they ask for to see them? I don't know how it will work tbh

No rules against that whitley87... nothing at all to worry about.

If it's new they'll fully understand why you don't have books yet.

Are they likely to contact my new employer to inform them about the TD?

There would usually be no reason to do that so long as you're responding to their reasonable requests for information and making your payments.
