Good Afternoon.
I paid my last payment on 01st October after 6 long years. Carrington Dean are saying could be 3 months before I am discharged.
I am desperate to sell my property due to a marriage breakdown. Can I ask can I start doing this now or do I need to wait on the discharge paper work so that they have no claim on any profit I would now make? I had hoped it would take 1 month but CD are saying 3-6 and I really cannot wait that long to sell the property having already had to wait 18months to see out the TD.thanks so much
Hi smit0310,
That's great news that you're at the end of your Trust Deed, and I totally get why you don't want to take any chances right at the last hurdle. There's no right answer here, and the safe bet is to wait until you have the discharge in your hand, but you should also be able to get your Trustee to confirm their position with the property. Often this is spelled out right up front as part of the Trust Deed conditions.
It's also not uncommon unfortunately that the Trustee's discharge can take several months.
Thanks
Paul
