We are going through something very similar but I have complained ours has never been reviewed. We never missed a single payment and a very high amount was written off by creditors in 2025 more than half yet told my husband on the phone 4 years he remember the conversation crystal clear. I asked for clarification on the end date and told 2032 there is only 2 smaller creditors left. I have emailed the company regarding how we feel and asked to be reviewed. Awaiting a response which could be a lengthy wait! as we are not happy at all with how they can justify such a long term especially with such a large figure being written off by the the other creditors last year Literally sole disstructing and I will take all to above complaint teams and government bodies I just need to know how to formerly complain to the company

Hi Hawthornflk,

I can see Paul has provided a very balanced and reasonable response.

Not sure why, but this is the first I am seeing this post. Regarding your comments about "predatory" and "ripe for regulation", these are emotive terms which are generally unfair across the sector. You are correct that Insolvency Practitioners should be alive to the fact that they are dealing with individuals who (by the very nature of their financial situation) are vulnerable. Likewise, it is a complex area of law and they should ensure prospective clients feel able to make an informed decision.

New regulations were brought in by the FCA in 2023, and further regulations were brought in 2024 by the Scottish Government, including a statutory cooling off period and additional provision of information to individuals, prior to granting a Trust Deed.

Paul's 'blunt' comment stands true. The industry is a mix of Accountancy / Restructuring firms who offer PTDs alongside Sequestration and Corporate Insolvency; and firms who were setup with the sole purpose of operating Trust Deeds. Anybody who feels they are being "sold" or pressured into a solution, should seek alternative advice. Our job is to provide you with the information you require to make an educated and informed decision about the best path forward for you.

If you feel you have grounds to complain regarding the administration of your Trust Deed, you should follow the complaints procedure published on your Trustee's website. If unsatisfied with their response, you can escalate your complaint via the Insolvency Complaints Gateway.

Hi Hawthornflk,

Firstly, i'm sorry you've not had a reply from anyone. Secondly I'm sorry that your post was held in moderation, so would not have been visible to everyone. Hopefully, now people can read and comment.

Of course, i don't know the details of your situation, but it sounds like a Trust Deed has been a bad recommendation for you and your circumstances. Unfortunately I hear from too many people who are 'sold' a trust deed that is clearly not the solution for them. I also hear too often about people in a trust deed who can't contact their insolvency company. You should look at their complaints policy and try that in the first instance. Failing that, their governing body can be contacted if you still feel you're not receiving a satisfactory duty of care.

You are right also about a lot of the potential consequences that individuals will face when in a trust deed - it is an important duty of a trustee to make sure that an individual is aware of this and factor these potential consequences into whether a trust deed is the right solution for that individual.

I'd also add, bluntly, that there are better and worse providers of trust deeds in the market. Trust deeds are highly effective solutions for people, but that requires a thorough assessment, and transparency over what that means.

You won't be the only person on this forum to have had these issues, so hopefully others can contribute with their experience and thoughts.

I see that in over a month this hasn't had a reply from the "insolvency experts" working in the field, since they have no answer and understand that the sector they work in is predatory and ripe for regulation.

As an update, we have spent over a month taking time off work and losing money to go to viewings, spending £150 on fuel on our car that is about to break. And received about 20 formal rejections, 40 ghosted applications

Please if you are reading this DO NOT ENTER A TRUST DEED. Credit agencies do not care about you, they will even label your PTD under the category of "Bankruptcy" which it legally is not - they also refuse to change it. Letting agencies don't care and go with whoever is the easiest, which will NOT be you.

You will not be able to have a place to live. Social housing has a delay of YEARS - you will be on the streets or put up in a hotel for months.

I was put in a trust deed in 2023 for a debt of 8,700 with income of 35,400 and no assets. I have since increased my income to 60,000 as I entered it quite young.

I didn't know how much of it would be fees. I knew there would be some, but did not think it would be that much. I called whoever I could because I was panicked and felt like I was drowning.

It provided a bit of relief at the start, but I didn't know how much it would affect my life. I read it would "negatively impact credit" but I didn't know just how much. It doesn't feel like I have "bad credit" it feels like I am not even allowed any credit, even a phone plan.

We have a notice to quit from our landlord because he wants to move a family member in, though conveniently after we said about an underlying issue that needs repairing. We have tried to look for properties and get rejected constantly. We then went with private landlords to explain the situation, and they would smile and node and say they understand. We would offer to use a guarantor company like RentGuarantor, but still hear nothing just silent rejections.

We can't go to social housing because I earn too much, I can't go to mid market because I earn too much. I can't make a final settlement because of their stupid fees making a debt of 8.700 balloon to almost 15k! If it were England I could make a reasonable final offer but that isn't a thing here anymore.

We are at risk of homelessness, my job is remote and cant work in a hotel or b&b, we have cats... I'll probably lose my job and have to give away our cats.

All because of being pushed into this trust deed with no assets. If anything is reading this and considering it please know it will be impossible to find a house to rent. Our car also broke down and sure we could "extend the payments" for another year so I could save up for a car but that's ridiculous when it's just filling the pockets of Bankruptcy accountants. I can't get leasing, pcp, hp, any type of car finance so I cannot drive my disabled refugee wife to any appointments.

The insolvency company are basically uncontactable, it takes months to reply if they even do, from south asian support lines via email. It is essentially impossible to have meaningful communication with them
