<p><span>I’m looking for anyone with actual experience of this situation in Scotland.</span></p>
<p><span>We currently own our home jointly. One joint owner went bankrupt (sequestration) and, at the time of the bankruptcy, the trustee calculated an amount relating to their share of the equity in the house. An arrangement was made to pay this amount rather than the house being sold.</span></p>
<p><span>There is still a balance being paid towards that equity.</span></p>
<p><span>The other joint owner has never been bankrupt and has a clean credit history.</span></p>
<p><span>We are now considering selling our current house and buying another property with a new joint mortgage.</span></p>
<p><span>Has anyone actually been through this situation?</span></p>

<p><span>I’m particularly interested in what happened with the </span><span>sale proceeds, the outstanding equity amount, and getting a new mortgage</span><span>.</span></p>
<p><span>Was the outstanding amount simply settled from the sale proceeds, allowing the property to be sold and a new mortgage to be arranged?</span></p>
<p><span>I’d really appreciate hearing from anyone who has actually experienced this in Scotland, rather than general advice about bankruptcy and if you did can you say which financial broker you used for this .</span></p>

<p>I entered a trust deed with Carrington Dean in January 2024 with it being active the following month, this was also at a time I was due to remortgage. when doing my initial budget the mortgage payment was incorrectly quoted to me by Natwest (hadn't applied my repayment from previous deal during lockdown and holiday payments). Long story short I was out around £200 from what was listed ion my TD and what I was actually spending. Despite efforts to get this sorted I was told it was effectively too late and i'd need to wait until the next annual review. </p>
<p>&nbsp;</p>
<p>So 12 months on from what was probably that hardest financial year of my life, I tried contacting CD to arrange the annual review. Despite numerous efforts, emails, phone calls to overseas departments, this review wasn't done until November 2025 as it was impossible to get in contact with anyone who could speak English. Only after when i posted a google review did someone from Creditfix contact me asking first to remove my review, and then they could sort the review - sounds like blackmail? Anwyay, got the review done and payments were finally reduced to match the mortgage figure.</p>
<p>Recently, there have been a few very unfortunate and unforseen events which ive had to pay/ help pay for (mother in laws funeral), that's now left me without the money i need to fix my car which then costs for for me to get to and back from work and i cant help feeling this would never be an issue if contacting them was simpler? The constant stress of dealing with such an incompetent company is deeply affecting me. It is IMPOSSIBLE to speak to someone from the UK. </p>
<p>&nbsp;</p>
<p>Is there any way to break your TD or transfer it to a different broker? Should I complain to the Ombudsman? I feel it wouldn't get me anywhere but i cannot handle this anymore.</p>

<p>Further that, reading recent google reviews has installed more paranoia that once my TD is complete, it seems like a lot of people are still having to pay their debts due to them not being paid during the TD by Carrington Dean - I think from my statements, from the £17,000 I've paid thus far, only a few tho9usand has reached my debtors, with the rest being listed as CD's Admin fees.</p>

<p>Be very wary of using this company, i would genuinely have preferred to go down the long route of paying it back myself without them. </p>]]></content:encoded>

<div>I am looking for some guidance from the experts/advisers on here before I contact my Trustee.</div>

<div>I am currently 2.5 years (30 months) into a 4-year Scottish Protected Trust Deed and have maintained a completely flawless payment record from day one.</div>
<br />
<div>Recently, I made an honest mistake regarding an employer wage advance, and I am anxious about how to handle it:</div>

<div><b data-path-to-node="6,0,0" data-index-in-node="0">What happened:</b> My wife joined me from abroad, and I urgently needed to buy basic household essentials to set up our accommodation. I requested an advance on my wages from my employer, which is being repaid at £25 per week directly through payroll deduction.</div>

<div><b data-path-to-node="6,1,0" data-index-in-node="0">How I covered it:</b> To ensure my regular income was not affected and my PTD contribution was never at risk, I took on 2 to 3 extra working hours every week specifically to pay back the £25 weekly deduction.</div>

<div><b data-path-to-node="6,2,0" data-index-in-node="0">The mistake:</b> At the time, I genuinely thought taking an advance on my own earned pay was permissible without checking first. I didn't view it as taking out commercial credit. I have now realized that taking any form of advance/credit without prior Trustee approval is technically a breach of standard PTD terms.</div>

<div>There was zero intent to hide anything or break the rules, and I want to self-disclose this to my Trustee to keep everything transparent. However, after 30 months of smooth payments, I am terrified of doing or saying the wrong thing.</div>

<div>Before I send an email to my Trustee, I would really appreciate advice on the following:</div>

<div><b data-path-to-node="9,0,0" data-index-in-node="0">How severe is this in practice?</b> Is an employer wage advance (covered by extra hours) likely to be treated as a minor technical issue, or does it carry a serious risk of defaulting the PTD?</div>

<div><b data-path-to-node="9,1,0" data-index-in-node="0">How do Trustees usually handle this?</b> Will they usually just issue a written reminder about credit rules, or will they take formal action?</div>
</li>

<div><b data-path-to-node="9,2,0" data-index-in-node="0">What is the best way to present this?</b> Should I attach the employment loan addendum and payslips right away in my first email, or just state what happened first?</div>

<p>I have a credit karma account and all my accounts were showing on this with the defaults and my bankruptcy was also showing but I noticed late last year everything had disappeared </p>
<p>the only accounts now showing on my file are my current accounts and none of the previous accounts.</p>
<p>I thought everything would be on my file for 6 years after my discharge or does it stay on from 6 years when I entered into the trust deed.</p>
<p>Also when I’m applying for insurance do I have to declare that I was bankrupt or does that only apply until I’ve been discharged</p>

<p>If my salary goes up do I need to pay more per month?</p>
<p>Do i still need to complete a annual review per year?</p>
<p>Can I pay more than £100 per month? if I have extra one month £125,  next month £110, so I can reduce the time? </p>
<p>What word should i look for if it is not the case, that I still need to pay based on my income/expenditure? Readng through the Form 1b I dont see any wording that suggest to me that it is still based on my salary income <span style="color:#aaa">removed link</span> </p>

I was made unemployed in June due to caring commitments for my disabled son and also became a single mum to both kids at the same time. My whole income is now solely benefits but when I called my trust deed they said they could make me sell my house and my trust deed would fail if I couldn't keep payments. I have read in here that they are not supposed to take benefits as income what would happen in this situation? Tried to change so many times unsuccessfully even before the debts. Was never advised my house was part of the deal. I was told 4/5 years maximum. In 2024 35k was written off. Contacted trustee company they said the write off made no difference, took it on the chin as we still had outstanding debt thought 2027 was the end date. This trust deed has never ever been annually reviewed. Last month I contacted them to clarify end date and query the write off. They replied saying 2032 end date pay 304 a month have never missed a payment! Stressed out my box. I made my reply very clear that I would like a review. Basically had a reply back saying more or less tough didn’t word like that but said there would be no review and the had interest in property and would run until 2032. I asked in the email for a review and slapped back with terms and conditions, which I never even knew about. My wife is has several disabilities and severe mental health issues along with 2 disabled children. Cost of living rising really struggling with this I only have 2 creditors left after the massive write off. I have asked yet again for a complaint procedure I await a response. This is insane now. How on earth can this be allowed? Can someone in knowledge please advise my next steps I’m not happy. They’d have been as well cutting the rope back in 2023 I can’t go much longer like this. I faced my debt head on near broke my back I know I have until 2027 as explained on the phone in 2023!!! Please someone advise this is VERY URGENT&#x1f64f;&#x1f3fb;&#x1f64f;&#x1f3fb;&#x1f64f;&#x1f3fb; This has turned into a money making scheme by my trust deed company now. <p>I wonder if you may be able to help set my mind at ease.</p>
<p>I entered into a PTD in 2021, the trustee discharged themselves and closed the PTD in 2024 due to my circumstances. This was filed with AiB and I was removed from the RoI 12 months later.</p>
<p>I was involved in a car accident in 2025 and have subsequently accepted an offer of settlement in 2026. I have written confirmation from AiB that the PTD was closed in 2024 and written confirmation from the trustee dated 2024 that states "this can be used as evidence of the failure" they also mention their discharge from it.</p>
<p>I sent these documents to my personal injury solicitor, however they remained adamant and have now sought to contact the old trustee given them a timeframe in which to indicate no claim or state a claim. The PI solicitor has already sent me emails with false/confused information, stating my vesting period is up until 2028 when my PTD was granted in 2021 and closed in 2024. I can forgive that as their area is PI not PTD.</p>
<p>As the trustee discharged themselves and closed the PTD in 2024, refusing to discharge me from my debts (which is fine with me), to my knowledge, that trumps the four year vesting period. The car crash was after the closure date by 10 months and the settlement by 2 years.</p>
<p>I am certain that they then cannot garrnish any of the PI settlement as the timeline dates after the PTD closure. It is my opinion that they cannot have a claim against it as it was not an asset present within the PTD timeframe.</p>
<p>I am fully aware that I now need to deal with creditors indepdently and I have payment plans already with them. However, am I right in saying that the old tustee has no claim over the settlement given the trustee discharge, ptd closure and timeframes?</p>
