                        <content:encoded><![CDATA[<p>I have just logged into my online portal and noted 2 letters of warning for arrears. I was of the belief I was up to date as I always check my bank. For this instance- the payment was pending and then I forgot about it. The payment this month did not come off so I went looking into why. </p>
<p>Religiously payment has been pushed back due to lack of funds even tho there is money in my account and it usually comes off on the computers second attempt. </p>
<p>It has been this way for well over a year. <br /><br /></p>
<p>when I logged into today I read these letters saying payment wasn’t made and to get In touch. It also states they gave me options to repay which they didn’t as I didn’t know about it. I have not received a phone call, an email or had any letters through the mail box as I have changed address. I contacted them about change of address and they informed to get in touch once I received a letter with my name and new address on it which I have not yet had and it has been one month or so since the move. <br /><br /></p>
<p>in the second letter the arrears quoted an amount of £0.00 </p>
<p>I have missed payment after checking but it was Unkown to me, I have payed what is due and what was missed, </p>
<p>&nbsp;</p>
<p>what I want to know is why was these letters created, why didn’t I receive any other contact via telephone or email for something they appear to be taking so seriously. Is the amount quoted a mistake? Where do I stand with such errors, </p>

My 12 month is coming up in August so I will be discharged. My question is if I suddenly have a spare £100 a month 18 month after the initial bankruptcy is finished can a DCO be set up still after this period? There isn’t any reason I will suddenly have this surplus income at the moment but I feel like I would like to know how it works. I’ve found the whole process quite stressful.                         <content:encoded><![CDATA[<p>I was put in a trust deed in 2023 for a debt of 8,700 with income of 35,400 and no assets. I have since increased my income to 60,000 as I entered it quite young.<br /><br />I didn't know how much of it would be fees. I knew there would be some, but did not think it would be that much. I called whoever I could because I was panicked and felt like I was drowning.<br /><br />It provided a bit of relief at the start, but I didn't know how much it would affect my life. I read it would "negatively impact credit" but I didn't know just how much. It doesn't feel like I have "bad credit" it feels like I am not even allowed any credit, even a phone plan.<br /><br />We have a notice to quit from our landlord because he wants to move a family member in, though conveniently after we said about an underlying issue that needs repairing. We have tried to look for properties and get rejected constantly. We then went with private landlords to explain the situation, and they would smile and node and say they understand. We would offer to use a guarantor company like RentGuarantor, but still hear nothing just silent rejections.<br /><br />We can't go to social housing because I earn too much, I can't go to mid market because I earn too much. I can't make a final settlement because of their stupid fees making a debt of 8.700 balloon to almost 15k! If it were England I could make a reasonable final offer but that isn't a thing here anymore.<br /><br />We are at risk of homelessness, my job is remote and cant work in a hotel or b&amp;b, we have cats... I'll probably lose my job and have to give away our cats.<br /><br />All because of being pushed into this trust deed with no assets. If anything is reading this and considering it please know it will be impossible to find a house to rent. Our car also broke down and sure we could "extend the payments" for another year so I could save up for a car but that's ridiculous when it's just filling the pockets of Bankruptcy accountants. I can't get leasing, pcp, hp, any type of car finance so I cannot drive my disabled refugee wife to any appointments.<br /><br />The insolvency company are basically uncontactable, it takes months to reply if they even do, from south asian support lines via email. It is essentially impossible to have meaningful communication with them</p>]]></content:encoded>

<p>Been lurking on this forum for a couple of weeks.</p>
<p>Like everyone that has ended up on a Trust Deed, I have a debt problem.</p>
<p>I have had initial discussions with a debt advisor but I want to see some other viewpoints. </p>
<p>My figures are likely higher than most trust deeds. Significantly I imagine.</p>
<p>My total debt level is around the £60,000 mark. I am on a salary of around £41,000.</p>
<p>With my income and outgoings I do not believe that I will be able to repay all my debts in a reasonable time. I.E if I applied for a DAS it would take me the maximum allowed 10 years at a significantly high figure. Which leads me to the TD option. </p>
<p>How likely am I to be accepted with these types of figures? A ballpark figure that I could afford to pay would probably sit around the £400pm mark so would lead to significant write off. I have a high amount of creditors (all unsecured loans, credit cards, catalogues and BNPL, usual suspects).</p>
<p>At this point I still have a perfect payment history. Problem being I use credit to pay credit all the time and my credit cards at this point will show some luxury spend (just then timing of it). </p>
<p>My credit cards aren't miles off their limits now and I need help with my debt problem. Its just got away from me the last year or two.</p>
<p>Is it a good idea at this point to contact all creditors myself and offer token repayments for a few.months. If I do this I will also apply for a Moratorium. </p>
<p>&nbsp;</p>
<p>What I am concerned about is being rejected because my I and E doesn't add up (I have been robbing peter to pay paul for ages and my bank statements are chaos. Or being rejected because I have recent spend which would be deemed as luxury. </p>
<p>If I clip all my debt myself now and wait a few months before looking at a TD would that leave me in a stronger position as my bank statements would look cleaner and show a more realistic viewpoint of my day to day ins and outs.</p>
<p>One thing is for sure is that this can no longer go on. Any advice is greatly appreciated.</p>]]></content:encoded>

An opportunity has come up from my husbands family member who has offered us to rent off them a 3 bedroom flat (essentially to give us an extra bedroom for our daughter). We are currently with an agency, but this will be a family member who is ware of my circumstance and wont be performing credit checks.  The rent is an extra £100 per month and its my husband who pays the rent, not me. (the trust deed is in my name only). My husbands parents have offered to gift us £800 for our deposit. Can you advise if this will effect my current trust deed? </p>]]></content:encoded>

<p>I feel I was misled when signing up to the trust deed I was not made aware that this would be the case, that it would be 100% of my disposable income. No where in the paperwork does  it says this. </p>
<p>As the trust deed company as to follow FCA regulations, it was there duty of trust/care that they inform me of this  "100% of my disposable income" would need to be paid, this was not made clear to me that, this would be the case.</p>
<p>&nbsp;</p>
<p>They did not disclose this important information  it would have effected my decision to do the Trust Deed or not. so misleading me.</p>
<p>&nbsp;</p>
<p>Looking at DAS it seems that would have been a better option for me. If my salary increases alot. They did not compare the scenario between DAS and Trust Deed for me to make choose that's best for me.</p>

<p>Was i Mis-sold??  What can I do now?</p>

<p>Surely they cant hide this information if they follow FCA regulations are customers must be informed of this. such a important bit of information. </p>

<p>If I were to receive a bonus from work, that covered all future contributions, would that be sufficient to end the trust deed or would I be required to pay considerably more? I.e. the actual total debt owed including any that had been written off as part of the trust deed?</p>
