                        <content:encoded><![CDATA[<p>Hi everyone, just entered my trust deed and gained protected status last week. </p>
<p>I had arrears from the CMS, which at the time of entering the trust deed, was being collected by Collect and Pay, meaning I was paying a 20% premium on top of the Maintenance + Arrears repayments. My trustee was working on my behalf to remove the Deduction of Earnings order that was being deducted from my wage at work to stop the arrears repayments but in the middle of all this, my ex partner has changed the payment method to Direct Pay, meaning I now pay her direct and the 20% charge does not apply now.</p>
<p>But in their new calculation, CMS have included the arrears payment in the total I've to pay her per month. Can someone confirm A) I should only pay her the actual Child Maintenance amount less the arrears so that I do not break my Trust Deed and B) how does she receive the arrears payments that I'm making when paying my trust deed payments....is she now the debtor and not CMS? I ask as I believe the CMS won't update their calculation for a few months, I've been advised by my Trustee that they are terrible to deal with and they take an age to update anything and my next payment is due in a couple of weeks...</p>

<p>Looking for some advice please. I have tried my best to keep up with my monthly debt payments and now in over my head. My debts are around 30k. I have been looking into the various debt solutions and think a trust deed would be best for me. Without going into too much detail, all the household bills are in my wife's name and I transfer her money each month for my half. I have no issue showing my bank statements to prove this but it will be impossible for me to get access to her bank statements to show proof of household bills. Is this going to be problem to enter a trust deed and if so, can anyone assist with any other solutions I can enter instead?</p>

<p>I never thought I'd end up on here again.....</p>
<p>I have been abroad for a few months and come back to 4 letters from Cabot Financial and elderly parents concerned that debt collectors have been repeatedly phoning them.</p>
<p>This is Cabot chasing up a debt that was written off when I completed my trust deed was successfully completed in 2013.</p>
<p>I phoned them up, and they say that the debt is still live on their system. God knows why this is suddenly on their radar again after all this time.</p>
<p>I have no remaining records of my trust deed as I thought it was all over years ago, there is no record on the AiB website as it was that long ago, and I doubt my IP has maintained records for this long either.</p>
<p>How can I prove to these clowns that I don't owe them money?</p>

<p>I am just about to complete my third review for my trustee. Nervous as I have had a salary increase, but also monthly outgoing increase, so hoping they will review this accordingly. I have a medication I am now paying privately for, which is around £130 per month - is this something that they take into consideration for affordability? It's not something I plan to come off but I didn't even think about my TD when I started this in March<br /><br />Once I have completed my third review this year, next year I believe my TD will end in October 2026. Do I do another review at this point, or is my Form 5 automatically processed? Carrington Dean isn't exactly very forthcoming with the information.</p>

<p>I am considering applying for a trust deed due to having very little money left each month due to huge interest on cards, loans etc. I would have tried to push through but my daughter has recently been diagnosed with a potentially life threatening condition. I want to get this sorted now otherwise I could find myself defaulting on all my debts.</p>

<p>When it comes to gambling on statements does it need to be clear for a certain period or do you have to prove you are seeking help for the issue?. I want to address now before my world potentially comes falling down.</p>
